Minnesota Marijuana Laws and Penalties

If you enjoy smoking marijuana for recreational or medical reasons and you live in Minnesota, you need to be aware of the laws you are breaking and the penalties that come associated with this crime. While marijuana is legalized for medicinal use in several states throughout the country, medicinal marijuana is not recognized in the state of Minnesota; however, this state has decriminalized the personal use of marijuana to a certain degree. Below you will find all of the current laws and penalties associated with marijuana.

Possession of Marijuana:

If you are caught with less than 42.5 grams of marijuana it is classified as a misdemeanor, which does not require any jail time; however, the judge may find that you will need to undergo drug education in replacement of jail time. This charge also features a maximum fine of $200.

If you are caught with 42.5 grams to 22 pounds of marijuana, then you will be charged with a felony offense, which may require up to five years of prison time. This charge carries a maximum $10,000 fine. If you are caught with 22 to 110 pounds of marijuana is a felony offense, which requires up to 20 years in prison and a maximum fine of $250,000. If you are caught with 110 to 220 pounds of marijuana you will be charged with a felony offense and a maximum jail sentence of 25 years and a fine of $500,000. Lastly, if you are caught with 220 pounds or more of marijuana then you will charged with a felony offense and a maximum jail time of 30 years and $1,000,000.

If you are caught driving in your car when more than 1.4 grams of marijuana then you will be charged with a misdemeanor, which requires up to 90 days in jail and a possible fine of $1,000; however, this charge is only applicable for marijuana found within the seating areas of your car, not in the trunk.

Sale of Marijuana:

If you are caught selling 42.5 grams of marijuana you will be charged with a misdemeanor, which does not require any jail time and a maximum fine of $200. Like possession, you may be required to undergo a drug education program. If you are caught selling less than 11 pounds of marijuana, you will be charged with a felony offense, which may require five years of jail time and a maximum fine of $10,000.

If you are caught selling between 11 to 55 pounds of marijuana, you will be charged with a felony offense, which requires up to 20 years in jail and a maximum fine of $250,000. Selling 55 to 110 pounds of marijuana is a felony offense, which may require up to 25 years in prison and a maximum fine of $500,000. If you are caught selling more than 110 pounds of marijuana, you will be charged with felony charge, which may require up to 30 years in prison and a maximum fine of $1,000,000. If you are caught importing more than 110 pounds of marijuana you will be charged with a felony and a maximum jail time of 35 years and a fine of $1,250,000.
